Preamble:
The company ShareYourTrip SAS (hereinafter referred to as “Best-itinerary”) publishes a travel itinerary platform accessible on the website https://best-itinerary.com, offering visitors to the site free travel itineraries, as well as a travel assistance service.
Article 1: Subject
These general terms and conditions of sale govern the relations between Best-itinerary and any natural person not engaged in commerce in the context of the sale of the services presented on the site.
Any order of services implies acceptance of these general terms and conditions of sale, which you can print and keep.
Best-itinerary reserves the right to adapt or modify the general terms and conditions of sale at any time. The modified general terms and conditions will be applicable from the date of their publication.
The buyer will be called “Customer” in this document.
Article 2: Services
The services governed by these general conditions are those listed on the website https://best-itinerary.com and which are indicated as being accessible by payment.
The Customer is required to consult them before placing an order. However, if there are errors or omissions in relation to this description, Best-itinerary cannot be held responsible.
Article 3: Price
The services offered by Best-itinerary are provided at the rates in force on the website, in a proposal or in a customer quote.
The price cannot be changed once the customer order has been validated.
An invoice is issued by Best-itinerary and sent to the Customer by email when the requested services are rendered.
It is agreed between the parties that payment by the Customer of the total fees of the service provider constitutes acceptance and final acceptance of the services.
Best-itinerary does not apply any discount for early payment.
The sale prices of the services are expressed in euros, including all taxes (TTC). The service costs:
-Weekend package (2 days): €100 incl. VAT
– 1-week package (3-13 days): €36 incl. VAT / day
– 2-week package (14-20 days): €32 incl. VAT / day
– 3-week package (21-27 days): €29 incl. VAT / day
– 4-week package (28 days or more): €27 incl. VAT / day
These rates are indicative and may vary depending on the complexity of the trip. For any specific request, the price is based on a quote.
Article 4: Order conditions
Best-itinerary intervenes at the customer’s order. These last ones have contacted the teams of the site by email, phone, instant messaging or via a form on the website.
A free first contact is planned to detail the customer’s needs and to provide Best-itinerary with the necessary and essential information related to the search for the components of the trip and the creation of a proposal according to the customer’s expectations.
Once the proposal is accepted by the Customer, he must pay the full price of the service for Best-itinerary to be able to start its research work.
To validate their request, the Customer must send Best-itinerary proof of a bank transfer made to the company’s bank account in the case of a bank transfer, or specify by email that the payment has been made in the case of an online payment, according to the terms specified in article 5 “Payment methods” below.
If the request is feasible and after payment, Best-itinerary will send the Customer by email a first document including the links to book the different services within a deadline agreed with the Customer after validation of their request. Best-itinerary is not responsible for the final decision or the booking of the Customer.
Best-itinerary undertakes to send another document to the Customer by email, the roadbook (or travel journal) within a deadline agreed with the Customer.
Once Best-itinerary has communicated the details of the transport, accommodation, activities, etc. the Customer will proceed, as soon as possible, to purchase on the sites proposed by Best-itinerary. Best-itinerary cannot in any way be held responsible if the prices and availability indicated in the email reply are no longer available at the time the Customer wishes to make the reservation.
Article 5: Payment method
The price is payable in full by the Customer on the day of validation of the proposal, in accordance with the terms set out in Article 4 “Order conditions”.
Payment is made by the Customer by bank transfer after providing the bank details of Best-itinerary or by credit card via the online payment module of our partner Voxpay.
Best-itinerary is not under any obligation to provide the services requested by the Customer if the Customer fails to pay the price of the services in accordance with the conditions set out in these General Terms and Conditions of Sale.
Payment made by the Customer is not considered final until Best-itinerary has actually received the sums due.
In the event of non-compliance with the payment conditions set out above, Best-itinerary also reserves the right to suspend or cancel the provision of the services requested by the Customer and to suspend the performance of its obligations.
In addition, a fixed fee of €40 per invoice is payable for collection costs in accordance with Article L 441-6 of the French Commercial Code, paragraph 12. This fixed fee is cumulative with the penalty clause. Best-itinerary reserves the right to ask the Customer for additional compensation if the actual collection costs exceed this amount, on presentation of supporting documents.
Article 6: Length and termination
The duration of the services is defined in the estimate, email, proposal or letter of acceptance of the estimate that is considered a contract. Each party may immediately terminate the contract in the event of the cessation of activity of one of the parties, cessation of payments, judicial reorganization, liquidation or any other situation producing the same effects, after sending a formal notice to the judicial administrator (or liquidator) that has remained unanswered for more than one month, in accordance with the applicable legal provisions.
Article 7: Right of withdrawal
The Customer accepts that the services begin before the expiry of the withdrawal period. As a result, and in accordance with the law, the Customer may not exercise their right of withdrawal for the services offered by Best-itinerary.
Article 8: Limitation of liability
Considering the nature of the services provided, Best-itinerary’s obligation is to exercise due care. Best-itinerary undertakes to provide the services in accordance with the best practices and in the best possible manner, in accordance with the terms and conditions of the agreement, and in compliance with applicable legal and regulatory provisions, to the exclusion of any obligation of result.
Best-itinerary cannot be held liable for any difficulties that may arise during the conclusion or execution of a trip or contracts between the Customer and transportation companies, accommodation providers, travel agents, or any other person or service provider involved in the proposed trip, nor can it be a party to any dispute between the Customer and that person.
Best-itinerary cannot be held liable for the poor outcome of a stay, a flight or train cancellation, a bad travel or service experience, a climate or economic problem. The reservation and choice of the trip will be the sole responsibility of the Customer. The service offered by Best-itinerary is only a consulting and time-saving service in terms of booking the components of the trip.
Best-itinerary undertakes to carry out regular checks to verify the functionality and accessibility of the site. To this end, Best-itinerary reserves the right to temporarily interrupt access to the site for maintenance reasons.
Best-itinerary does not guarantee to the Customer that the services, which are constantly being improved to improve performance and progress, will be completely free of errors, defects, or defects, that the services will meet all their needs and expectations.
Article 9: Protection of personal data
Under the law relating to data processing, files and freedoms, the Customer has a right of access, rectification and opposition to the processing of his data, by contacting the following address: bestitinerary.com@gmail.com
Article 10 – Settlement of disputes and jurisdictional competences
If the Customer does not comply with one of the provisions of these general conditions of use and, in general, any difficulty relating to the execution, interpretation or validity of these, are subject to French law and the courts French.
Article 11: Customer acceptance
These General Conditions are expressly approved and accepted by the Customer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general conditions of purchase, which will be unenforceable against Best-Itinerary, even if he has knowledge of it.
